Agreement to Terms
By accessing or using Itinrary ("the app," "the service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms apply to everyone: travelers who create and share trips, and the people who open a shared trip link to follow along.
Description of Service
Itinrary is an app for sharing a trip with a private group of people you choose. You create a trip, invite people to it, and post updates as you go with photos, videos, voice notes, and a place. The people you invited can view the trip, comment, and react. You can also turn trip photos into a postcard and send it by email.
A trip stays available to look back on after it ends.
To create and share trips, you need an account. You can sign up with an email address and password, or sign in with Google or Apple. You are responsible for keeping your credentials confidential and for everything that happens under your account.
People can view a shared trip without creating an account. By opening a shared trip link, they agree to these terms.
You must be at least 13 years old to use Itinrary. If you are under 18, you need permission from a parent or guardian.
Accounts
Location
Every update carries a place. You can let the app read your device location once while you are composing an update so it can suggest that place, or you can type the place yourself. Location permission is optional, and the app works without it.
Itinrary does not track your location in the background. Our handling of your data is described in our Privacy Policy.
Your Content
What you create in the app stays yours: your trips, photos, videos, voice notes, captions, and postcards. By posting content to the service, you grant us a limited license to store, process, display, and transmit it as needed to operate the service for you and the people you shared it with. That license ends when you delete the content, except for copies that remain in routine backups until they age out.
You are responsible for what you post. Only post content you have the right to share, and get the agreement of the people in your photos and videos before you post them.
Acceptable Use
You agree not to use Itinrary to:

Post content you do not have the right to share

Post another person's location or images without their agreement

Stalk, harass, threaten, or intimidate any person

Post unlawful, abusive, hateful, or sexually explicit content, or content that exploits minors

Send postcards or invitations to people who have not agreed to hear from you, or use them for bulk or commercial messaging

Share trip links publicly when the traveler did not intend that

Interfere with or disrupt the service or its infrastructure

Attempt to access data belonging to other users

Violate any applicable law or regulation
We may remove content or suspend or terminate accounts that violate these terms.
Payments and Purchases
Your first trip is free. After that, Itinrary offers one time purchases: individual trips, trip bundles, and unlimited access. These are non recurring; there are no subscriptions. Pricing is shown at the time of purchase.
In the iOS and Android apps, purchases are made through the Apple App Store and Google Play and are processed by Apple and Google, and their terms and refund policies apply. On the web, purchases are processed by Stripe. Refund requests are handled by Apple for App Store purchases and by Google for Google Play purchases. Following a shared trip is free and never requires a purchase.
Intellectual Property
The Itinrary name, logo, and app design are our intellectual property. You may not use our branding without written permission.
Disclaimers
Itinrary is not a safety or emergency service. Sharing a trip may give the people at home comfort, but the app is not a substitute for emergency services, personal safety devices, or direct communication. Do not rely on Itinrary to know that someone is safe.
The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

The service will be uninterrupted or error free

Notifications or emails will be delivered promptly or at all

Uploads will always succeed, or that content will never be lost

Suggested place names, map pins, or weather information will be accurate
Posting an update requires a working internet connection, and upload speed and reliability depend on your network and device.
Limitation of Liability
To the maximum extent permitted by law, Itinrary and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service. This includes, without limitation, damages for loss of data, personal injury, or property damage.
Our total liability for any claim arising from the service shall not exceed the amount you paid us.
Idemnification
You agree to indemnify and hold harmless Itinrary and its operators from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the service, your violation of these terms, or your violation of any rights of another person.
Third-Party Services
Itinrary relies on third party services, including Google Firebase, Mux for video, SendGrid for email, map and weather data providers, and payment processors (Apple, Google, Stripe, and RevenueCat). Your use of those services is subject to their own terms and privacy policies. We are not responsible for their availability or accuracy.
Changes to the Service
We may modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to notify users of significant changes. Continued use after changes constitutes acceptance of them.
Changes to These Terms
We may update these terms from time to time. We will notify you of material changes by posting a notice in the app or on our website. Continued use after updated terms are posted means you accept them.
Governing Law
These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law principles.
Termination
You may stop using the service and delete your account at any time. We may suspend or terminate your access if you violate these terms, or for any other reason at our discretion, with or without notice.
On termination, your right to use the service ends. We handle your data as described in our Privacy Policy.
